Welcome to DonaTalk! These Terms of Service (“Terms”) govern your use of our website, products, and services (“Platform”). By accessing or using DonaTalk, you agree to be bound by these Terms.
1. Overview
DonaTalk connects individuals who wish to present ideas (“Pitchers”) with those willing to listen (“Listeners”), facilitating charitable donations through these interactions. After a successful meeting, the Pitcher’s escrowed funds are donated to the Listener’s chosen non-profit organization.
2. Eligibility
Users must be at least 18 years old and capable of forming legally binding contracts. By using DonaTalk, you represent and warrant that you meet these requirements.
3. User Accounts
To access certain features, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Platform Usage
- Pitchers: Set a donation amount and share a unique link to schedule meetings with Listeners.
- Listeners: Set a preferred donation amount and share a unique link to receive pitches from Pitchers.
- Meetings: Conducted virtually, with donations held in escrow until the meeting is confirmed as completed by both parties.
5. Donations and Escrow
- Escrow: Donations are held securely until both parties confirm the meeting occurred.
- Completion: Upon confirmation, funds are released to the Listener’s selected non-profit organization.
- Cancellation: If a meeting is canceled or not confirmed, funds are returned to the Pitcher.
6. Prohibited Conduct
Users agree not to:
- Use the platform for unlawful purposes.
- Impersonate any person or entity.
- Interfere with the platform’s operations.
- Engage in fraudulent or deceptive activities.
7. Intellectual Property
All content on DonaTalk, including text, graphics, logos, and software, is the property of DonaTalk or its licensors and is protected by intellectual property laws. Unauthorized use is prohibited.
8. Disclaimers
DonaTalk provides the platform “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of any information on the platform.
9. Limitation of Liability
To the fullest extent permitted by law, DonaTalk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform.
10. Indemnification
You agree to indemnify and hold harmless DonaTalk and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the platform or violation of these Terms.
11. Modifications
DonaTalk reserves the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of the platform constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
